Last Shot Apparel Custom Order Terms and Conditions

1. Method of Payment
For wholesale orders, 50% deposit due prior to production commencement via:

  • Interac e-Transfer to info@lastshotapparel.com

  • Electronic Funds Transfer (EFT; banking details provided upon request)

  • Credit card (subject to a 3% transaction fee).
    Payments are non-refundable once production begins.

2. Custom Nature of Products
2.1 Last Shot Apparel ("Company") manufactures custom apparel and products ("Products") strictly according to specifications provided by the purchaser ("Customer").
2.2 Products may include custom embellishments (e.g., embroidery, printing), sizing, fabrics, colors, and designs as explicitly approved by Customer. Company disclaims all liability for unapproved, ambiguous, or incomplete specifications.

3. Customer Specifications and Approvals
3.1 Customer is solely responsible for providing precise, complete specifications, including exact dimensions, measurements, Pantone colors, font sizes, placement details, and quantities for all custom elements. Failure to do so voids any claims for errors.
3.2 Customer must review and expressly approve all design proofs, mockups, and samples (digital or physical) in writing before production. Approval confirms Customer's satisfaction with all details.
3.3 No further changes permitted after approval. Company relies on Customer's approval as final and binding.

4. Final Sale; No Returns, Exchanges, or Refunds
4.1 All sales of custom Products are final upon order placement and approval. Production voids rights to returns, exchanges, refunds, or cancellations.
4.2 Customer assumes all risk for fit, color accuracy, design suitability, and usability based on their specifications and approvals.

5. Limited Warranty and Claims
5.1 Sole warranty: Products free from manufacturing defects in material/workmanship for 30 days post-delivery, provided they match approved specifications.
5.2 Claims must be submitted in writing with photos within 5 business days of receipt. Company reserves sole discretion to inspect, repair, replace (at next production run), or issue partial credit—not exceeding order value. No consequential damages.
5.3 No warranty for: customer errors/omissions in specs; normal wear; misuse; or deviations within industry tolerances (e.g., ±1/2" sizing, 10% color variance).

6. Limitation of Liability
6.1 Company's maximum liability shall not exceed the order's paid amount. Company not liable for indirect, incidental, or consequential damages (e.g., lost profits, event delays).
6.2 Customer indemnifies Company against third-party claims arising from Customer's specifications or approvals.

7. Retail (Non-Custom) Products
7.1 Retail items (non-customized, off-the-shelf apparel and accessories) may be returned within 30 days of delivery if unused, unworn, unwashed, in original packaging with tags attached, and resaleable condition.
7.2 Customer pays return shipping unless due to Company error (wrong item shipped). Refunds issued to original payment method within 10 business days of receipt/inspection. No restocking fees.
7.3 Exclusions: Final sale items marked as such; hygiene items (underwear, masks); clearance/discounted goods.​

8. Blank Sample Orders
8.1 Blank (unembellished) samples requested for evaluation are assessed case-by-case.
8.2 Approval required prior to order; customer pays upfront. If sample returned unused, in original condition within 14 days (prepaid shipping by customer), Company will issue store credit or refund (less original shipping).

9. Governing Law

These terms governed by Alberta, Canada law. Disputes resolved in Alberta courts.
